Bring Kakwenza to court Dead or Alive! Another court order issued for the fair hearing of Ugandan author.

For the second time, court has demanded for the release of Novelist Kakwenza Rukirabashaija. The order is to present him to court whether he be dead or alive! His arrestors have been ordered to vomit his corpse if at all he is dead.

This was after his wife, Eve Basiima sued the higher ups in her husband's arrest for example the Elite Special Forces Command boss Brig. Général Peter Candia, the director of Criminal Investigations directorate Grace Akullo, the Inspector General of Police Martins Okoth Ochola for continuous detention of her husband without trial. Eve Basiima filed the application before the Civil División of the High Court.

Eve Basiima said she only got an opportunity  to see him on Monday when he was driven to their home in Iganga district to conduct a house search for three hours and she added that he looked tortured, frail and was limping with a blood stained vest and underwear.

The high court has ordered everyone she has sued to immediately produce the suspect before court Dead or alive. The new court order lists everyone that Eve Basiima has sued  and goes ahead to command that Kakwenza be brought to court Dead or Alive.

This is the second time that an order is passed since on Tuesday, Makindye Magistrate's grade one magistrate Irene  Nambatya issued an order directing government to unconditionally release Kakwenza. This was due to the fact that he had been constrained without trial which violates his constitutional right to liberty and fair hearing.

The state has continued to defy the court order and Kakwenza's lawyer Eron Kiiza has also been denied access to his client.

"Police are fearing to produce him in court with torture marks, that's why they are delaying to bring him to court."
